The terms on which Zhuge Holdings Pty Ltd makes this website available, including your rights under the Australian Consumer Law.

1. Acceptance

By accessing or using this website you agree to these terms of use. If you do not agree with them, please do not use the site. We may revise these terms at any time by publishing an updated version on this page; the version in force is the one published when you use the site.

2. Nature of this website — no advice

This website describes the activities of Zhuge Holdings Pty Ltd as a private holding company. The content is general information only. It is not financial, investment, taxation, accounting or legal advice, and it does not take into account your objectives, financial situation or needs.

Nothing on this site is an offer, invitation or recommendation to acquire, dispose of or deal in any financial product or interest, and nothing on it constitutes financial product advice. Zhuge Holdings Pty Ltd does not hold an Australian Financial Services Licence and does not provide services to the public that require one. 3. Your rights under the Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you may have under the Australian Consumer Law in Schedule 2 to the Competition and Consumer Act 2010 (Cth), or any other law, where doing so would be unlawful.

Where a service we supply to you as a consumer comes with a guarantee that cannot lawfully be excluded, and our liability for failing to meet that guarantee may be limited, our liability is limited — at our option — to supplying the service again or paying the cost of having it supplied again.

4. Permitted use

You may view, download and print pages of this site for your own information and record keeping. You must not:

  • use the site for any unlawful purpose or in breach of these terms;
  • copy, reproduce, republish or redistribute its content for commercial purposes without our written permission;

Except as permitted by clause 4 or by statute, you may not use our content or marks without our prior written consent. All rights not expressly granted are reserved.

6. Accuracy of information

We prepare the content of this site carefully and update it as our circumstances change, but we do not warrant that it is complete, current or free from error. Company details such as our ABN and ACN are published for identification; the authoritative records are those held by the Australian Securities and Investments Commission and the Australian Business Register.

7. Enquiries you send us

The contact form on this site opens your own email application and sends a message from your address to ours. Email is not a secure or guaranteed method of delivery, and we cannot promise that a message sent to us will arrive or be read within any particular time. Do not send us confidential or sensitive material by email unless we have agreed to receive it that way.

An enquiry does not create any contractual, fiduciary or advisory relationship between you and Zhuge Holdings Pty Ltd. Personal information you send is handled in accordance with our privacy policy.

Where this site refers to a third-party organisation or website, that reference is for convenience only. We do not control those sites, do not endorse their content, and are not responsible for anything they publish or do.

9. Availability

10. Limitation of liability

Subject to clause 3, and to the maximum extent permitted by law, Zhuge Holdings Pty Ltd and its directors, officers and agents are not liable for any loss or damage — including indirect, incidental, special or consequential loss, loss of profit, loss of revenue, loss of data or loss of opportunity — arising out of or in connection with your use of, or reliance on, this website or its content, however that loss arises, whether in contract, tort (including negligence), statute or otherwise.

Subject to clause 3, our total aggregate liability arising out of or in connection with your use of this website is limited to one hundred Australian dollars.

11. Indemnity

You indemnify Zhuge Holdings Pty Ltd against any claim, loss, damage, cost or expense we suffer arising from your breach of these terms or your unlawful use of this website, except to the extent it is caused by our own negligence or breach.

12. Termination

We may suspend or terminate your access to this website at any time, without notice, if we reasonably consider you have breached these terms or that your use is unlawful or harmful. You may stop using the site at any time. Clauses 5, 7, 10, 11, 13 and 14 survive termination.

13. Governing law and jurisdiction

These terms are governed by the laws of the State of Victoria, Australia, and by the Commonwealth laws applying in Victoria. You and we submit to the non-exclusive jurisdiction of the courts of Victoria and of the courts competent to hear appeals from them.

14. General

If any provision of these terms is found to be invalid or unenforceable, it is severed to the extent necessary and the remaining provisions continue in force. Our failure to enforce a provision is not a waiver of it. These terms, together with our privacy policy, are the entire agreement between you and us in relation to your use of this website.
